PURPOSE AND EFFECT: The purpose of the proposed rule is the repeal of Rule 69A-37.050, F.A.C.

SUMMARY: Rule 69A-37.050, F.A.C., lists and describes firefighter training certificates issued by the Division of State Fire Marshal. The enactment of Chapter 2013-183, L.O.F., resulted in substantial changes to Section 633, F.S. Those changes included the listing and description of Division-issued firefighter training certificates under Section 633.408, F.S. The law, as revised, renders Rule 69A-37.050, F.A.C., redundant of statute; the rule is repealed.

SUMMARY OF STATEMENT OF ESTIMATED REGULATORY COSTS AND LEGISLATIVE RATIFICATION:

The Agency has determined that this will not have an adverse impact on small business or likely increase directly or indirectly regulatory costs in excess of $200,000 in the aggregate within one year after the implementation of the rule. A SERC has not been prepared by the Agency.

The Agency has determined that the proposed rule is not expected to require legislative ratification based on the statement of estimated regulatory costs or if no SERC is required, the information expressly relied upon and described herein: The Department has conducted a review of the proposed rule and has determined that the repeal of Rule 69A-37.050, F.A.C., will have no adverse impact or result in regulatory costs exceeding any of the criteria established in paragraph 120.541 (2)(a), Florida Statutes.

Any person who wishes to provide information regarding a statement of estimated regulatory costs, or provide a proposal for a lower cost regulatory alternative must do so in writing within 21 days of this notice.
