NOTICE IS HEREBY GIVEN that the Division of Florida Condominiums, Timeshares, and Mobile Homes, Department of Business and Professional Regulation, State of Florida, has received the petition for declaratory statement from Dennis Warren, President, In Re: Lake Tyler Condominium Association, Inc., Docket No. 2015009839, filed on March 23, 2015. The petition seeks the agency’s opinion as to the applicability of Section 718.112(2)(d)4.a., Florida Statutes, as it applies to the petitioner.

Whether Section 718.112(2)(d)4.a., Florida Statutes, requires the Association to hold an election each year and, if answered in the affirmative, which properly seated 2-year Directors should have their terms involuntarily reduced by one year to create vacancies.
