    The Department of Environmental Protection hereby gives notice:

    On March 16, 2018, the Department of Environmental Protection issued a Final Order granting Lee County Utilities’ Petition for a Variance. The Petition was received on August 16, 2017. Notice of receipt of this Petition was published in the Florida Administrative Register on August 23, 2017. The petition requested a variance from the requirement in Rule 62-610.466, F.A.C., to meet primary drinking water standards in reclaimed water prior to injection at the Aquifer Storage and Recovery (ASR) wellheads at the Fort Myers Beach and Fiesta Village Wastewater Treatment Plants. The injectate has undergone treatment and high-level disinfection to meet Public Access Reuse standards. No public comments were received. The Order, OGC Case No. 17-0966, granted the variance to Rule 62-610.466, F.A.C., because the Petitioner demonstrated that it meets the requirements for a variance and that the purpose of the underlying statute will be achieved by other means.
