NOTICE IS HEREBY GIVEN that the Board of Nursing has issued an order disposing of the petition for declaratory statement filed by Marlene Cesar on July 18, 2018. The following is a summary of the agency's disposition of the petition: The Notice of Petition for Declaratory Statement was published in Volume 44, No. 141, of the July 20, 2018, Florida Administrative Register. Petitioner seeks a Declaratory Statement from the Board as to whether it is within the scope of Chapter 464 for the Petitioner to serve as a nursing division head while not being licensed as a registered nurse in Florida. The Board’s Order, filed on February 4, 2019, finds that there is no definition of a “division head” that oversees nursing programs in Chapter 464, Florida Statutes. paragraph 464.019(1)(a), Florida Statutes, requires that a program director for a nursing program be licensed as a registered nurse in Florida. Since the position title “division head” is not defined in Florida Statutes, the Board declined to answer the petition.
