NOTICE IS HEREBY GIVEN that the Board of Nursing has issued an order disposing of the petition for declaratory statement filed by McCeil J. Johnson on February 16, 2016. The following is a summary of the agency’s disposition of the petition:

Petitioner seeks a Declaratory Statement from the Board regarding the Florida Board of Nursing requirement that online faculty instructing Florida residents must hold a RN license in Florida. The Board’s Order, filed on May 23, 2016 denied the Petition stating that it was not in substantial compliance with the provisions of Section 120.565, F.S., and Rule 28-105. F.A.C. The Petition does not cite a statute or rule that addresses the unlicensed practice of nursing in Florida.
