NOTICE IS HEREBY GIVEN that Office of Financial Regulation has declined to rule on the petition for declaratory statement filed by HAPUS, LLC on December 30, 2013. The following is a summary of the agency’s declination of the petition:

The Petition for Declaratory Statement filed by HAPUS, LLC., does not state with particularity its set of circumstances and therefore the Office cannot answer Petitioner’s questions as to how statutes and rules apply to Petitioner’s circumstances. This denial does not preclude the filing of a new petition in the future that complies with Section 120.565(1) and (2), Florida Statutes, by stating the Petitioner’s circumstances with particularity and by specifying the statutory provision or provisions on which the Petitioner seeks a declaration.
