NOTICE IS HEREBY GIVEN that the Florida Building Commission has received the petition for declaratory statement from Barry A. Schneer, JD/MBA. The petition seeks the agency’s opinion as to the applicability of Section 105, Florida Building Code, Existing Building (2010) as it applies to the petitioner.
Petitioner asks whether Section 105 creates a “rebuttable presumption” for a homeowner to demonstrate to a building official that unpermitted work satisfies the building code.
