The South Florida Water Management District (District) provides notice of extension of the deadline set forth in subsection 120.74(5), Florida Statutes that requires publication of a Notice of Proposed Rule by April 1 for the above rules listed on the District’s 2019/2020 Regulatory Plan.
1. Concise statement identifying issues causing the delay in rulemaking: These rules are needed to implement the 2016 Water Bill codified in Section 373.4595, Florida Statutes. The District needs additional time to consider the comments received at its public workshops, the effect of FDEP’s January 2020 and February 2020 BMAPs on the District’s rule, and recommendations from the Blue-Green Algae Task Force.
2. Applicable notice as published in the Florida Administrative Register: The District published a Notice of Rule Development on November 1, 2016 (Vol. 42/No. 213) followed by three Notices of Extension on March 24, 2017 (Vol. 43/No. 58), March 23, 2018 (Vol. 44/No. 58), and March 29, 2019 (Vol. 45/No. 62). The District published a second Notice of Rule Development on October 22, 2019 (Vol. 45/No. 206) and hosted five public workshops throughout the affected region.
3. Expiration: Pursuant to subsection 120.74(5), Florida Statutes, this extension expires on October 1, 2020.
