NOTICE IS HEREBY GIVEN that on February 28, 2014, the Criminal Justice Standards and Training Commission, received a petition for a temporary two month waiver of subsection 11B-27.00212(11), F.A.C., by James Iverson. Petitioner wishes to waive that portion of the rule which requires an officer to obtain employment within four years of separating from a previous employment. The Petitioner states that he is in the process of becoming employed by Plant City Police Department since February 4, 2014 with an Oral Review Board. The agency is in the process of conducting Petitioner’s background investigation as part of Petitioner’s pre-hiring package. The Petition states that the operation of the rule would violate the principles of fairness because Petitioner is in the midst of his pre-hiring requirements and his certificate is set to expire March 31, 2014. The Petition states that the operation of the rule creates a substantial hardship for both Petitioner and Plant City Police Department in that neither will have the benefit of employing Petitioner after completing an already extensive pre-employment screening.
