    The Florida Fish and Wildlife Conservation Commission hereby gives notice: it issued a Final Order granting the Pinellas County Parks and Conservation Resources Department a permanent variance from the requirement in subsection 68D-23.109 (3), Florida Administrative Code, that the size of signs used as information, danger, or regulatory waterway markers shall be no smaller than three feet by three feet. The Final Order authorizes Petitioner to use signs of 24 inches by 18 inches to mark the Weedon Island Preserve Paddling Trail in Pinellas County, Florida.

    General Basis for Agency Decision: The Petitioner demonstrated that the use of smaller signs on Weedon Island Preserve Paddling Trail will still ensure waters of the state are marked in such a manner as to promote safe navigation on Florida’s waterways, the purpose of the rule and the statutes it implements. The Petitioner further demonstrated that if the request for a variance is denied, they will face substantial financial hardship associated with purchasing and installing the more expensive, larger signs.
