62-701.300Prohibitions

The Department of Environmental Protection hereby gives notice: That it has issued an order on March 4, 2019, granting New River Solid Waste Association’s Petition for a Waiver. The New River Solid Waste Association intends to conduct a research project which includes evaluation of three proposed septage injection systems that discharge septage into a municipal solid waste landfill. The Petition was received January 9, 2019. A Notice of Receipt of this Petition was published in the Florida Administrative Register on January 11, 2019. The Petition requested a waiver from paragraph 62-701.300(10)(a), F.A.C., which prohibits the placement of non-containerized liquid waste in solid waste disposal units. No public comment was received. The Order, file number OGC 19-0029 granted the Petition to paragraph 62-701.300(10)(a), F.A.C., based on a showing that the Petitioner demonstrated that a strict application of the rule would result in substantial hardship to Petitioner or would affect Petitioner differently than other similarly situated applicants and because Petitioner demonstrated that the purpose of the underlying statute will be or has been achieved by other means.
