RULE NO.:RULE TITLE:
64B8-51.001Manner of Application
The Board of Medicine hereby gives notice: of the issuance of an Order regarding the Petition for Variance or Waiver, filed on November 6, 2023, on behalf of Saba Jazmin Kazravan, DNP, MSN, MBA, RNFA, CNOR, C-SSGB, RN. The Notice of Petition for Variance or Waiver was published in Vol. 49, No. 218, of the November 8, 2023, Florida Administrative Register. Petitioner sought a variance and or wavier from subsection 64B8-51.001(2), F.A.C., which requires that all applications must include an official transcript from a school of electrology which identifies the credits taken by home study or correspondence courses and those taken in classroom settings. The Board considered the Petition at a duly-noticed meeting held on December 1, 2023, in Orlando, Florida. The Board’s Order was filed on December 20, 2023. The Board finds that Petitioner has met the purpose of the underlying statute through documentation of graduation from Milpitas and finds that the literal application of the rule in question would place a substantial hardship upon the Petitioner. The Board hereby GRANTS Petitioner a permanent waiver of subsection 64B8-51.001(2), and paragraph 51.002(1)(e), F.A.C.
