    Board of Optometry

    The Board of Optometry hereby gives notice that on March 2, 2017, an Order was filed on the Petition for Waiver or Variance. The petition was filed by Akram Masood, O.D., on December 2, 2016, seeking a waiver or variance from subsection 64B13-4.001(2), F.A.C., with regard to the requirement that applicants for licensure must have achieved a score of 75% or better on all 4 parts of the licensure examination, including three enumerated portions of Part III, within the seven (7) year period immediately preceding application for licensure. The Notice was published in Volume 42, No. 250, of the Florida Administrative Register, on December 28, 2016. The Board, at its meeting held on February 17, 2017, voted to grant the Petition for Waiver or Variance finding that the Petitioner has achieved the purpose of the underlying statute by other means, in that Petitioner’s scores on the examination have established he is currently minimally competent to practice optometry. In addition, the Board finds that strict application of the Rule’s provisions to Petitioner would violate principles of fairness.
