RULE NO.:RULE TITLE:
64B2-13.007Continuing Education During Initial Licensure Period
The Board of Chiropractic Medicine hereby gives notice of the issuance of an Order regarding the Petition for Waiver or Variance, which was filed on January 20, 2016, by Vicki L. Moore, D.C. The Notice of Petition for Waiver or Variance was published in Volume 42, Number 15, of the January 25, 2016, Florida Administrative Register. The Petitioner was seeking a waiver or variance of subsection 64B2-13.007(1), F.A.C., entitled “Continuing Education During Initial Licensure Period,” which requires that during the first twelve (12) months after initial licensure, practitioners are required to attend one (1) full day at a Florida Board of Chiropractic Medicine meeting at which disciplinary hearings are conducted as provided in subsection 64B2-13.004(8), F.A.C.
The Board considered the instant Petition at a duly-noticed meeting, held February 5, 2016, in Orlando, Florida. The Board’s Order, filed on March 2, 2016, granted the petition finding that Petitioner established that the purpose of the underlying statute would be met by granting a variance or waiver from subsection 64B2-13.007(1), F.A.C. The Board further finds that Petitioner established that applying the requirements of the aforementioned rule to her circumstances would violate principles of fairness and impose substantial hardship.
