    NOTICE IS HEREBY GIVEN that Construction Industry Licensing Board has issued an order disposing of the petition for declaratory statement filed by Paul J. Del Vecchio on December 14, 2016. The following is a summary of the agencys disposition of the petition:

    The Notice of Petition for Declaratory Statement was published in Volume 42, No. 246, the December 21, 2016, Florida Administrative Register. Petitioner asks the Board the following two questions: (a) Can an interior designer licensed under Chapter 481, Fla. Stat., but not licensed under Chapter 489, Fla. Stat., enter into a contract directly with a homeowner to offer construction services provided he/she hires licensed contractors to obtain permits and perform construction activities? (b) If a licensed contractor enters into the above agreement with a licensed interior designer is he/she aiding and abetting unlicensed activity? The Board’s Order, filed on March 2, 2017, declines to issue a declaratory statement on the first question because the Board does not have jurisdiction over Chapter 481, Fla. Stat., and the Petition asks about the conduct of another person. The Board answers the second question in the affirmative. The applicability of this Declaratory Statement is limited to the set of facts incorporated herein.
