    62-521.400Ground Water Protection Measures in Wellhead Protection Areas

    NOTICE IS HEREBY GIVEN that on February 14, 2017, the Florida Department of Environmental Protection received a petition for variance or waiver from Petitioner, 7-Eleven, Inc. The petition requests a variance from paragraph 62-521.400(1)(l), Florida Administrative Code (F.A.C), to allow for the installation and operation of two new petroleum underground storage tanks (USTs) within the 500-foot wellhead protection area of a public water system well; the new USTs will be double-walled with automatic leak detection surpassing the environmental performance standards pursuant to Chapter 62-761, F.A.C. Paragraph 62-521.400(1)(1), F.A.C., only provides that new USTs must be located outside a wellhead protection area; however the rule does not reflect revised criteria for new UST systems which, due to the double-wall protection and the duplicative leak detection warning, allows safe placement of a modern UST within 500 feet of a public water system well. The front parcel has an address of 1103 Leeland Heights Boulevard West, Lehigh Acres, Florida, 33936, and the other adjacent parcels are located at 1100 and 1102 Fillmore Avenue, Lehigh Acres, Florida, 33936. The petition has been assigned OGC No. 17-0088.
