64B16-26.351Standards for Approval of Registered Pharmacy Technician Training Programs

The Board of Pharmacy hereby gives notice of the issuance of an Order regarding the Petition for Waiver or Variance, which was filed on January 24, 2018, by Eric L. Harris. The Notice of Petition for Waiver or Variance was published January 26, 2018 in Volume 44, Number 18 of the, Florida Administrative Register. The Petitioner was seeking a waiver or variance of paragraph 64B16-26.351(1)(e), Florida Administrative Code, entitled, “Standards for Approval of Registered Pharmacy Technician Training Programs,” which states that pharmacy technician training programs must be approved on or before April 1, 2017, by the Florida Commission for Independent Education (CIE).

The Board considered the instant Petition at a duly-noticed public meeting held February 7, 2018 in Gainesville, Florida. The Board’s Order, filed on February 13, 2018, granted the petition finding that Petitioner had established that the purpose of the underlying statute would be met by granting a variance or waiver from paragraph 64B16-26.351(1)(e), Florida Administrative Code. The Board further finds that Petitioner established that applying the requirements of the aforementioned rule to his circumstances would violate principles of fairness and impose substantial hardship.
