    NOTICE OF CONTINUATION OF THE GENERIC PERMIT FOR POLLUTANT DISCHARGES TO SURFACE WATERS OF THE STATE FROM THE APPLICATION OF PESTICIDES

    62-621.300:Permits

    The Department gives notice of the continuation of the Generic Permit for Pollutant Discharges to Surface Waters of the State from the Application of Pesticides which is adopted by subsection 62-621.300(8), F.A.C. As part of the Department’s National Pollution Discharge Elimination System program, this generic permit regulates point source discharges from the application of pesticides (biological pesticides, or chemical pesticides which leave a residue) to surface waters of the state. The current generic permit became effective on April 14, 2011. Permit coverage under this generic permit is limited to a term not to exceed five years from the effective date of coverage.

    The Department reviews and evaluates the generic permit on a recurring basis and will update the permit as necessary to account for changes in technology, and applicable regulatory requirements. The generic permit is consistent with the current federal regulatory requirements. The generic permit may be re-opened by the Department or any person having a substantial interest in the rule may petition the Department to initiate rulemaking in accordance with Section 120.54(7), F.S.
