DEPARTMENT OF ENVIRONMENTAL PROTECTION

The Department of Environmental Protection hereby gives notice:
An order has been issued granting a variance to Manatee Management, LLC for its Material Recovery Facility in Manatee County, Florida. On January 28, 2011, Petitioner requested a variance from paragraph 62-701.710(7)(a), F.A.C., which requires submittal of proof of financial assurance for closure for a waste processing facility as part of the permit application. Petitioner demonstrated that it would suffer a substantial hardship if it was required to comply with this rule. The variance will allow Petitioner to delay providing financial assurance until the facility is actually constructed. No comments were received from the public in response to the Notice of Receipt that was published in the FAW on February 25, 2011.
