The Board of Clinical Laboratory Personnel hereby gives notice: that on April 2, 2019, an Order was filed on the Petition for Variance or Waiver. The Petition for Variance or Waiver was filed by Robert Harlan, on February 15, 2019, seeking a waiver or variance from Rule 64B3-5.003, F.A.C., for licensure as a technologist which require a minimum of a bachelor’s degree in clinical Laboratory, biological or Chemical Science and completion of a clinical laboratory training program, or three years pertinent clinical laboratory experience with a minimum of six months in each specialty for which licensure is sought. The Notice was published in Volume 45, No. 35, of the Florida Administrative Register, on February 20, 2019. The Board, at its meeting held on March 8, 2019, via telephone conference call, voted to deny the Petition for Waiver or Variance finding that the Petitioner did not demonstrate a substantial hardship; that application of the rule did not violate the principles of fairness; and that the purpose of the underlying statute was not met.
