The Board of Massage Therapy hereby gives notice: of the issuance of an Order regarding the Petition for Variance or Waiver, filed on December 20, 2018, by Mark Sametz. The Notice of Petition for Waiver or Variance was published in Vol. 45, No. 04, of the January 7, 2019, Florida Administrative Register. Petitioner sought a waiver of Rule 64B7-28.009, F.A.C., regarding continuing education. The Board considered the instant Petition at a duly-noticed public meeting held on January 28 and 29, 2019, in Orlando, Florida. The Board’s Order, filed on March 15, 2019, showed that that the purpose of the underlying statute is bing achieved by other means and that application of the above rule would cause a substantial hardship or violate the principles of fairness. The petition is granted, the Board will award Petitioner with hands-on, in-person approved continuing education cred for 12 hours of the course taken at Chetawan Traditional Massage School
