    NOTICE IS HEREBY GIVEN that on April 02, 2024, the South Florida Water Management District, received a petition for variance (Petition) from Bimini Square, LLC (Petitioner), 1918 9th Street East, West Fargo, ND 58078, for a project known as Bimini Square Mixed-Use Development, located in Lee County, Florida (Variance Application No. 240329-43097/Permit No. 36-110649-P), regarding Application No. 230718-39473/Permit No. 36-109871-P. The Petition seeks a variance from Section 3.4 of the “Environmental Resource Permit Applicant’s Handbook Volume II: For Use Within the Geographic Limits of the South Florida Water Management District”, incorporated by reference in Rules 40E-4.091 and 62-330.010, F.A.C., which require building floors to be at or above the 100-year flood elevation. Petitioner requests approval to construct an 8,719 square feet commercial use portion of a mixed-use building with a finished floor elevation of +6.20 National Geodetic Vertical Datum, which is below the 100-year flood elevation. Any interested person or other agency may submit written comments on the Petition within 14 days after publication of this notice.
