62-701.520Special Waste Handling

The Department of Environmental Protection hereby gives notice that it has issued an order on April 8, 2016 granting ATS Americas LLC’s Petition for a Waiver. The Petition was received on February 24, 2016. Notice of receipt of this Petition was published in the Florida Administrative Register on March 8, 2016. The Petition requested a waiver from paragraph 62-701.520(5)(d), F.A.C., which requires that treated biomedical waste be disposed of only at permitted Class I landfills or incinerators used to combust solid waste. No public comment was received. The Order, file number 16-0085, granted the Petition to paragraph 62-701.520(5)(d), F.A.C., based on a showing that the Petitioner demonstrated that a strict application of the rule would result in substantial hardship to Petitioner or would affect Petitioner differently than other similarly situated applicants and because Petitioner demonstrated that the purpose of the underlying statute will be or has been achieved by other means.
