NOTICE IS HEREBY GIVEN that Department of Children and Families has issued an order disposing of the petition for declaratory statement filed by Girl Scouts of Citrus Council, Inc., Girl Scouts of Gateway Council, Inc., Girl Scouts of Gulfcoast Florida, Inc., Girl Scouts of Southeast Florida, Inc., Girl Scouts Council of Tropical Florida, Inc. and Girl Scouts of West Central Florida, Inc., on March 31, 2016. The following is a summary of the agency's disposition of the petition:

The Notice of Petition for Declaratory Statement was published in Volume 42, No. 39, of the February 26, 2016, Florida Administrative Register. The Petitioners seek a declaratory statement as to applicability of Sections 402.301(6) and 402.302, F. S., as they apply to the petitioners. The Department’s Order on Petition for Declaratory Statement, filed on March 31, 2016, issued the following declaratory statement: A person volunteering at a Girl Scout Council program serving children is required to undergo background screening pursuant to sections 402.305 and 402.3055, Florida Statutes, unless that volunteer assists on an intermittent basis for less than 10 hours per month and is at all times in the line of sight of a person who meets the screening requirement of subsection 402.305(2), Florida Statutes.
