    11B-20.001Definitions and Minimum Requirements for General Certification of Instructors

    NOTICE IS HEREBY GIVEN that on April 8, 2016, the Criminal Justice Standards and Training Commission received a petition for a permanent waiver of subsection 11B-20.001(6), F.A.C. from Director Angela Sockwell, St. John’s River State College, Criminal Justice Training Program. The Petitioner wishes to permanently waive from August 13, 2015 to December 15, 2015 that portion of the rule that states: An individual found in violation of Section 943.13(4), F.S., or is guilty of the offenses set forth in paragraphs 11B-20.0012(2)(a)-(f), F.A.C., shall not instruct Commission-approved Basic Recruit Training, Advanced Training, or Specialized Training Program Courses for courses taught by Mindi Iannarelli. Petitioner states Petitioner states that on January 8, 2016 Ms. Iannarelli applied for General Instructor Certification at which time petitioner learned Ms. Iannarelli had pled Nolo Contendre to felony Driving While License Revoked as Habitual Offender on March 31, 2006. Petitioner states that this constitutes a lack of good moral character as defined in subsection 11B-27.0011(4), F.A.C. Petitioner states that immediately following this discovery Ms. Iannarelli‘s position as an academy instructor was terminated. Petitioner states that from August 13, 2015 through December 15, 2015, Ms. Iannarelli instructed 74 students in five different basic recruit programs. Petitioner states that strict application of the rule creates a substantial hardship and violates principles of fairness because of the students affected, 17 have obtained employment as law enforcement or corrections officers and if the rule waiver is not granted, the certifications for these 17 officers will become invalid and all 74 students will be required to return and re-take the physical training portion of their respective programs. Petitioner states the purpose of the underlying statute would be achieved if the waiver is granted.
