11B-27.002Certification, Employment or Appointment, Reactivation, and Terminating Employment or Appointment of Officers

NOTICE IS HEREBY GIVEN that on April 8, 2016, the Criminal Justice Standards and Training Commission, received a petition for a temporary waiver of paragraph 11B-27.002(4)(a), F.A.C. from Nickinson Dominique. The Petitioner wishes to temporarily waive that portion of the rule that states: within four years of the beginning date of a Commission-approved Basic Recruit Training Program, an individual shall successfully complete the program, achieve a passing score on the applicable State Officer Certification Examination, and gain employment, and certification as an officer. Petitioner states that he previously requested and was granted a six-month waiver on October 30, 2015. Petitioner states that he has been hired by the Miami-Dade Schools Police Department with a tentative start date of April 8, 2016. Petitioner states that the agency was unable to meet the mid-February anticipated hire date per the original support letter submitted on his behalf. Petitioner has again submitted a letter of support and offer of employment from the Chief of Police at the Miami-Dade Schools Police Department. Petitioner states that strict application of the rule creates a substantial hardship and violates principles of fairness because the Miami-Dade Schools Police Department has performed an extensive pre-employment screening and Petitioner would suffer an economic hardship as he sponsored himself through the basic academy and would have to sponsor himself again if the waiver is not granted. Petitioner states the purpose of the underlying statute would be achieved if the waiver is granted.
