    11B-27.002Certification, Employment or Appointment, Reactivation, and Terminating Employment or Appointment of Officers

    NOTICE IS HEREBY GIVEN that on April 11, 2016, the Criminal Justice Standards and Training Commission received a petition for a permanent waiver of paragraph 11B-27.002(4)(a), F.A.C., from Edlyne Frisbie. The Petitioner wishes to permanently waive that portion of the rule that states: within four years of the beginning date of a Commission-approved Basic Recruit Training Program, an individual shall successfully complete the program, achieve a passing score on the applicable State Officer Certification Examination, and gain employment, and certification as an officer. Petitioner states that she successfully completed a Basic Recruit Training Program from September 2011 through April 24, 2012 and passed the State Officer Certification Exam on April 24, 2012. Petitioner states that she was considered for an employment position with the Florida City Police Department under the mistaken belief that she had until April 24, 2016 to become employed. Petitioner states that due to the time limitation error, her hiring status with the Florida City Police Department has been temporarily placed on hold. Petitioner states that strict application of the rule creates a substantial economic hardship and violates principles of fairness because she would again have to attend Basic Recruit Training. Petitioner states the purpose of the underlying statute would be achieved if the waiver is granted.
