NOTICE IS HEREBY GIVEN that the Electrical Contractors’ Licensing Board has issued an order disposing of the petition for declaratory statement filed by Nex-Gen Fiber Services, Inc. on January 26, 2015. The following is a summary of the agency’s disposition of the petition:

The Notice of Petition for Declaratory Statement was published on February 5, 2015, in Vol. 41, No. 24, of the Florida Administrative Register. Petition sought the Board’s interpretation of Section 489.503(14), F.S., entitled “Exemptions,” as to whether the petitioner would need to be licensed in order to perform telecommunication and/or fiber optic work and if so, what type of specialty licensure would petitioner be required to obtain. The Electrical Contractors’ Licensing Board considered the Petition at its meeting held on March 13, 2015, in Orlando, Florida. The Board, in the Order filed on March 31, 2015, declined to answer the Petition for Declaratory Statement. The Board voted to deny answering the question presented in the petition because the Board finds that Section 489.503(14), F.S., clearly states who is exempt from licensure.

A copy of the Order Disposing of the Petition for Declaratory Statement may be obtained by contacting: Ruthanne Christie, Executive Director, Electrical Contractors’ Licensing Board, 1940 North Monroe Street, Tallahassee, FL 32399-0783.
