    NOTICE OF CANCELLATION

    The Department of Environmental Protection announces the cancellation of a hearing:

    DATE AND TIME: April 27, 2015 – May 1, 2015, 9:00 a.m.

    PLACE: The Plantation on Crystal River, 9301 West Fort Island Trail, Crystal River, Citrus County, Florida

    GENERAL SUBJECT MATTER TO BE CONSIDERED: CANCELLATION OF HEARING: The certification hearing scheduled for April 27, 2015 – May 1, 2015, and noticed on February 20, 2015, for the Duke Energy Florida Citrus Combined Cycle Project, Power Plant Site Certification Application number PA 77-09A3, DOAH Case number 14-3632EPP, DEP Office of General Counsel Case Number 14-0431 has been cancelled. In accordance with the Florida Electrical Power Plant Siting Act, Section 403.508(6)(a), F.S., on March 31, 2015, all parties to this proceeding stipulated that there are no disputed issues of material fact or law to be raised at the certification hearing and filed a motion requesting that the Administrative Law Judge cancel the certification hearing and relinquish jurisdiction to the Department of Environmental Protection. On April 1, 2015, Administrative Law Judge E. Gary Early issued an order granting the request pursuant to Section 403.508(6)(b), F.S. Pursuant to Section 403.509(1), F.S., the Department of Environmental Protection will prepare and issue a Final Order within 40 days of the Judge’s Order.
