The Agency for Health Care Administration hereby gives notice:

That on April 6, 2016, the Agency for Health Care Administration entered an order disposing of the emergency petition for permanent variance or waiver filed by the Public Health Trust of Miami-Dade County, Florida on March 7, 2016 and advertised in Vol. 42, No. 55, Florida Administrative Register on March 21, 2016. The Petition was assigned Agency Case Number 2016002484. The Agency for Health Care Administration has issued a Final Order granting a temporary variance from Rule 59C-1.044, F.A.C., which relates to the transplantation programs requiring certificates of need and defines pediatric patients. The temporary variance is granted to Petitioner for a period expiring on April 6, 2017 upon a finding that the purpose of the underlying statute will be achieved by other means and that application of the rule to Petitioner would create a substantial hardship.
