    Board of Nursing Home Administrators

    The Board of Nursing Home Administrators hereby gives notice: that on April 15, 2020, an Order was filed on the Petition for Variance or Waiver. The initial Petition was filed by Warren Keene, on January 17, 2020, an amended petition was filed on March 12, 2020 and a second amended petition was file on March 26, 2020. Petitioner sought a variance or waiver of Rule 64B10-15.001, F.A.C., with regards to the requirements for continuing education for licensure renewal which requires that every person licensed pursuant to Chapter 468, Part II, F.S. shall be required to obtain continuing education which contributes to increasing or enhancing the licensee’s professional skill or which enables the licensee to keep abreast of changes that affect the field of nursing home administration.

    The initial Notice of Petition for Variance or Waiver was published in Vol. 46, No. 14, on January 22, 2020, the first amended notice was published in Vol. 46, No. 56, on March 20, 2020, and the second amended notice was published in Vol. 46, No. 64, on April 1, 2020, in the Florida Administrative Register. The Board, at its meeting held on April 10, 2020, voted to deny the Petitions for Variance or Waiver finding that Petitioner failed to demonstrate a substantial hardship; failed to demonstrate that application of the rule would violate the principles of fairness; failed to demonstrate and that the purpose of the underlying statute had been met.
