    The Department of Health Prescription Drug Monitoring Program hereby gives notice of the issuance of an Order denying the petition for Variance or Waiver, filed on January 26, 2016, by Mary Lynn Ulrey, Chief Executive Officer of the Drug Abuse Comprehensive Coordinating Office. The Notice of Petition for Waiver or Variance was published on January 28, 2016, in Vol. 42, No.18, of the Florida Administrative Register. No comments were received in response to the petition. Petitioner sought a variance or waiver of the rule to allow individuals with direct access to the Prescription Drug Monitoring Program to appoint a designee to access on their behalf. The Department’s Order, filed on April 14, 2016, denied the Petitioner’s request because the Petitioner seeks a waiver of the statutory requirements in § 893.055(7), Fla. Stat. The Department has no authority to waive the provisions of statute.
