    11B-27.002Certification, Employment or Appointment, Reactivation, and Terminating Employment or Appointment of Officers

    NOTICE IS HEREBY GIVEN that on April 15, 2016, the Criminal Justice Standards and Training Commission, received a petition for a temporary waiver of paragraph 11B-27.002(4)(a), F.A.C., from Rudolph Elie. The Petitioner wishes to temporarily waive for that portion of the rule that states: within four years of the beginning date of a Commission-approved Basic Recruit Training Program, an individual shall successfully complete the program, achieve a passing score on the applicable State Officer Certification Examination, and gain employment, and certification as an officer. Petitioner states that he has been offered a conditional offer of employment with the Florida City Police Department if the waiver is granted. Petitioner states he successfully completed a Commission-approved Correctional Officer crossover training from May 16, 2011 through November 18, 2011. Petitioner states he achieved a passing score on the State Officer Certification Exam on January 12, 2012. Petitioner states that strict application of the rule creates a substantial hardship and violates principles of fairness because Petitioner would have to sponsor himself through another crossover program thereby incurring a six month loss of income. Petitioner states the purpose of the underlying statute would be achieved if the waiver is granted.
