11B-27.002Certification, Employment or Appointment, Reactivation, and Terminating Employment or Appointment of Officers

NOTICE IS HEREBY GIVEN that on March 23, 2016, the Criminal Justice Standards and Training Commission, received a petition for a temporary waiver of paragraph 11B-27.002(4)(a), F.A.C. from Chief Jason Shaw, Palatka Police Department on behalf of Orestes Cossio. The Petitioner wishes to temporarily waive for that portion of the rule that states: within four years of the beginning date of a Commission-approved Basic Recruit Training Program, an individual shall successfully complete the program, achieve a passing score on the applicable State Officer Certification Examination, and gain employment, and certification as an officer. Petitioner states that Mr. Cossio successfully completed a Commission-approved Basic Recruit Training Program from February 27, 2012 through July 26, 2012. Petitioner states that Mr. Cossio completed a new hire oral review with the Palatka P.D. and was selected to continue with the hiring process. Petitioner states that on February 4, 2016 Mr. Cossio was given a conditional offer of employment pending the outcome of the waiver request. Petitioner states that strict application of the rule creates a substantial hardship and violates principles of fairness because an expensive and extensive pre-employment process performed and would have to be repeated in addition to the financial hardship to Mr. Cossio. Petitioner states the purpose of the underlying statute would be achieved if the waiver is granted.
