    NOTICE IS HEREBY GIVEN that Construction Industry Licensing Board has declined to rule on the petition for declaratory statement filed by Patrick J. Hubbard on January 29, 2018. The following is a summary of the agency's declination of the petition:

    The Notice of Petition for Declaratory Statement was published in Volume 44, No. 25, of the February 6, 2018, Florida Administrative Register. Petitioner asks the Board for clarification of subparagraph 489.113(9)(b)2, F.S., with regard to the need for an engineer or architect for Division 1 or 2 work performed pursuant to this section. The Board considered the petition at its meeting held on March 16, 2018, in St. Augustine, FL. The Final Order was filed on April 10, 2018. The petitioner’s petition is vague and does not state a particular set of circumstances to which the statute in question would apply as required by s. 12.565, F.S. It is the Board’s opinion that subparagraph 489.1163(9)(b)2, F.S., is not ambiguous, and declines to clarify the statute.
