    NOTICE OF CHANGE

Notice is hereby given that the following changes have been made to the proposed rule in accordance with Section 120.54(3)(d)1., F.S., published in Vol. 43, No. 33, (February 17, 2017), issue of the Florida Administrative Register. Based on written material received by the department within the 21 days of the notice of proposed rule the department is making changes to proposed DEP Form 62-210.900(5), F.A.C., Annual Operating Report for Air Pollutant Emitting Facility, which is adopted and incorporated by reference in Rule 62-210.900, F.A.C. The department had proposed adding a requirement for facilities to triennially report emissions of particular combinations of hazardous air pollutants, not subject to an emissions-limiting standard, if the annual emissions equal or exceed 2500 pounds. However, because facilities are required to triennially report emissions of total hazardous air pollutants if the annual emission exceed 2500 pounds, and triennially report emissions of individual hazardous air pollutants if the annual emissions equal or exceed 1000 pounds, the additional reporting of emissions of combinations of hazardous air pollutants is not necessary. Therefore, the department is making changes to page 10 of the instructions to DEP Form 62-210.900(5) to make clear that those particular combinations of hazardous air pollutants do not need to be reported triennially. Emissions of combinations of hazardous air pollutants that are subject to an emission-limiting standard will still be required to be reported annually.
