    NOTICE IS HEREBY GIVEN that the Agency for Health Care Administration has received the petition for declaratory statement from Armor Correctional Health Services, Inc. ("Armor"). The petition was received by the Agency Clerk's office on April 16, 2013.The petition seeks the agency's opinion as to the applicability of Section 409.9025(1), Florida Statutes as it applies to the petitioner.
    The Petitioner is requesting that the Agency issue a Declaratory Statement advising whether: (a) the incarceration span violates the exception to denial of Medicaid benefits for inmates of correctional facilities, including Florida county jails, set forth in Section 409.9025(1), Florida Statutes; and (b) if the incarceration span violates Section 409.9025(1), Florida Statutes, are Florida Medicaid benefits available for inmates who are pregnant, disabled, blind, or female inmates over 65 years of age in need of breast/cervical cancer treatment.
