NOTICE IS HEREBY GIVEN that on April 22, 2015, the Florida Department of Law Enforcement Criminal Justice Standards and Training Commission received a petition for permanent waiver of paragraph 11B-27.002(4)(a), F.A.C., by Captain Gregory L. Foster, Investigations Commander, Nassau County Sheriff’s Office on behalf of Daniel R. Hanna III. Petitioner wishes to waive that portion of the rule that states within four years of the beginning date of a Commission-approved Basic Recruit Training Program, an individual shall successfully complete the program, achieve a passing score on the applicable State Officer Certification Examination, and gain employment, and certification as an officer. Petitioner states that the Nassau County Sheriff’s Office began processing applicant Daniel R. Hanna III’s employment paperwork on January 27, 2014. Petitioner states that due to staffing issues within the Sheriff’s Office, Mr. Hanna’s processing was suspended in order to process full-time applicants. Petitioner states that Mr. Hanna’s processing began again on June 26, 2014; however, his four-year window for employment expired on January 24, 2015. Petitioner states that if the waiver is granted, the Nassau County Sheriff’s Office intends to offer Mr. Hanna employment as a Reserve Deputy Sheriff.
Petitioner states that a strict application of the rule would violate principles of fairness because the lapse of the four-year employment window was through no fault of his own and forcing Mr. Hanna to re-enroll, pay for and complete another Basic recruit Training would create a substantial hardship. Petitioner states that the purpose of the underlying statute would be achieved if the waiver is granted.
