    The South Florida Water Management District hereby gives notice:

    On April 15, 2024, the South Florida Water Management District granted Palau Sunset Harbor Condominium Association, Inc.’s Petition for Variance (“Petition”) (Application No. 230803-39725/Permit No. 13-109326-P) filed on August 4, 2023, for Palau Sunset Harbor Condominium Stormwater Management System (Application No. 230407-38229/Permit No. 13-109440-P) located in Miami-Dade County, Florida. The Petition sought a variance from Section 3.4 of the “Environmental Resource Permit Applicant’s Handbook Volume II: For Use Within the Geographic Boundaries of the South Florida Water Management District” (“Vol. II”), incorporated by reference in Rules 40E-4.091 and 62-330.010, F.A.C., which requires building floor elevations to be at or above the 100-year flood elevation. Petitioner demonstrated that strict imposition of the criteria set forth in Section 3.4 of Vol. II would result in a substantial financial hardship because, without the variance, the building would have to be demolished and rebuilt, causing Petitioner to suffer a considerable financial loss, residents to lose their homes, and employees to lose their jobs. Petitioner also provided reasonable assurances that the underlying purpose of Chapter 373, Florida Statutes, would be achieved through the currently constructed floor elevation. Notice of receipt of the Petition for Variance was published in the Florida Administrative Register, Vol. 49, No. 161 on August 18, 2023. No comments were received.
