NOTICE IS HEREBY GIVEN that the Florida Department of Environmental Protection has received the petition for declaratory statement from Petitioner, Francis J. Goss, on April 22, 2019, amending the previously filed petition for declaratory statement received by the Department on April 3, 2019. A notice of declaratory statement was published in the Florida Administrative Register on April 17, 2019, Vol 45, Issue 75. The petition seeks the agency's opinion as to the applicability of Rule 62-340, F.A.C., and sections 373.421 and 373.4211, F.S., to a waterbody abutting property the Petitioner leases as it applies to the petitioner.
The petitioner removes a question that has been resolved by the St. Johns River Water Management District regarding whether a permit is required for Petitioner’s proposed project.
