11B-35.002Basic Recruit Training Programs for Law Enforcement, Correctional, and Correctional Probation
NOTICE IS HEREBY GIVEN that on April 24, 2017, the Criminal Justice Standards and Training Commission of the Florida Department of Law Enforcement received a petition for a temporary waiver of paragraph 11B-35.002(2)(a), F.A.C., from Jerry Murphy. Petitioner wishes to permanently waive that portion of the Rule that states: Within 4 years of the beginning date of a Commission-approved Basic Recruit Training Program, an individual shall successfully complete the program, achieve a passing score on the applicable State Officer Certification Examination pursuant to Rule 11B-30.0062, F.A.C., and gain employment and certification as an officer. In justification of his petition for waiver, Petitioner asserts that he began a Corrections Crossover Basic Recruit Training Program in July of 2012, and that during this time, and in the years after, Petitioner was employed as a certified corrections officer. Petitioner further asserts that he applied for law enforcement positions during and after his completion of the Corrections Crossover Program but was not selected for employment until October of 2016, due in part to an eight-month administrative investigation which did not resolve until August of 2016. Petitioner alleges that the Lee County Sheriff’s Office is still willing to employ him as a certified law enforcement officer. Petitioner alleges that, should the waiver not be granted, Petitioner will suffer a substantial hardship as he would be unable to serve as a certified law enforcement officer.
