PURPOSE AND EFFECT: To clarify that certain actions constitute operating a private school in a manner contrary to the health, safety, and welfare of the public and create an imminent threat to the health, safety, or welfare of the school’s students.
SUMMARY: The purpose of this amendment is to clarify that certain actions constitute operating a private school in a manner contrary to the health, safety, and welfare of the public and create an imminent threat to the health, safety, or welfare of the school’s students.
SUMMARY OF STATEMENT OF ESTIMATED REGULATORY COSTS AND LEGISLATIVE RATIFICATION:
The Agency has determined that this will not have an adverse impact on small business or likely increase directly or indirectly regulatory costs in excess of $200,000 in the aggregate within one year after the implementation of the rule. A SERC has not been prepared by the Agency.
The Agency has determined that the proposed rule is not expected to require legislative ratification based on the statement of estimated regulatory costs or if no SERC is required, the information expressly relied upon and described herein: The proposed rule is unlikely to have an adverse impact on small business or increase regulatory costs in excess of $200,000 in the aggregate within one year. This rule is also unlikely to impact the factors listed in 120.541(2)(a), F.S., and will not require legislative authorization. Private schools will still be able to operate in Florida; this rule merely makes it so that private schools owned by an individual or entity domiciled in or controlled by a foreign country of concern may be ineligible to receive state scholarship funds. At this time, it is unknown whether any private scholarship schools would be impacted.
Any person who wishes to provide information regarding a statement of estimated regulatory costs, or provide a proposal for a lower cost regulatory alternative must do so in writing within 21 days of this notice.
