NOTICE IS HEREBY GIVEN that the Division of Florida Condominiums, Timeshares, and Mobile Homes, Department of Business and Professional Regulation, State of Florida, has declined to rule on the petition for declaratory statement filed by Shelley Nachum, Petitioner, In Re: Delray Oaks Condominium Association No. 2, Inc., Docket No. 2012007072, February 14, 2012. The following is a summary of the agency’s declination of the petition:

The division declined to issue a Declaratory Statement because the division cannot issue a declaratory statement concerning events that have already taken place; where the facts are in dispute, or interpret and enforce rights under condominium documents, or determine whether negligence was involved; or when competent substantial evidence has not been provided without which the division cannot perform an administrative review.
