    Long-term Care (LTC) Waiver Renewal Request

    The Agency for Health Care Administration (Agency) is submitting to the Centers for Medicare and Medicaid Services (CMS) a request to renew the Long-term Care (LTC) waiver that operates under the authority of Section 1915 (c) of the Social Security Act. The Agency is providing public notice of the 30-day public comment period as specified in Title 42, Code of Federal Regulations (CFR) Section 441.304(f) to solicit meaningful input from enrollees, providers, and all stakeholders on the renewal request prior to submission to CMS.

    Description of Long-term Care (LTC) Waiver Renewal Request

    The Long-term Care waiver offers eligible disabled adults ages 18 to 64 and elderly adults ages 65 or older long-term care services in the community setting as an alternative to nursing facility placement. The program uses a managed care service delivery model to provide home and community-based services to eligible waiver enrollees. Competitively selected managed care plans offer long-term care services designed to meet the identified care needs of waiver recipients in their community. Enrollees’ case managers develop care plans based upon individual need assessments with input from the enrollee and others involved in the recipient’s care. Enrollees may select service providers from the managed care plan’s provider network.

    The State has made the following changes in the renewal application which differ from the original approved waiver:

    • Revise the case management provider qualifications;
    • Revise the performance measures;
    • Update the spousal impoverishment policy;
    • Update the waiver’s personal needs allowance description;
    • Add the requirements related to physical therapy;
    • Remove the structured family caregiving service;
    • Update the waiver specific home and community-based settings transition plan; and
    • Update the waiver’s unduplicated enrollee count and related waiver cost projections.

    The 30 day comment period will begin on Wednesday, April 27, 2016 and end on Friday, May 27, 2016. The Agency will post the draft waiver renewal request with a description of the changes on its website.
