The Department of Management Services, E911 Board, hereby gives notice of the issuance of an Order regarding the Amended Petition for Variance or Waiver for Highlands County Sheriff’s Office, filed on January 7, 2016. The Notice of Petition for Variance or Waiver was published in Volume 42, No. 6, of the January 11, 2016, Florida Administrative Register. The Board considered the Petition at a duly-noticed public meeting held on January 28, 2016. The Petitioner was requesting a Variance or Waiver of paragraph 60FF-5.002(3)(a), F.A.C., regarding the requirement that the E911 Board Form 6A must be provided with applicant’s “W Form 1A” application and be postmarked or delivered on or before October 1.

The Board's Order, filed on February 24, 2016, grants the Petition for Variance or Waiver, finding that Petitioner has complied with the requirements of Section 120.542(2) of the Florida Statutes. Specifically, Petitioner has demonstrated how the purpose of the underlying statute would be achieved by submission of the E911 Form 6A. Additionally, Petitioner has demonstrated that failure of the E911 Board to consider Highlands County’s grants application would cause a substantial hardship for Highlands Country. Based upon the foregoing, the Board determined that Petitioner is eligible for a waiver or variance of paragraph 60FF-5.002(3)(a), F.A.C.
