64B13-4.004Manner of Application

The Board of Optometry hereby gives notice on Petition for Waiver or Variance filed on January 12, 2016, by Elena Utkina, M.D. The Notice of Petition for Variance or Waiver was published in Volume 42, No. 16, of the January 26, 2016, Florida Administrative Register. The Petitioner sought a variance or waiver of subparagraph 64B13-4.004(1)(b)3., Florida Administrative Code, with regards to the requirement that an applicant must graduate from a school or college of optometry approved by the Board.

The Board's Order, filed on March 14, 2016, denies the Petition. Petitioner has not demonstrated that the request meets the purpose of the underlying statute would be achieved by other means and or that application of the above rule would cause a substantial hardship or violate the principles of fairness.
