    61C-5.001: Safety Standards

    The Department of Business and Professional Regulation, Division of Hotels and Restaurants, Bureau of Elevator Safety hereby gives notice: On April 29, 2013, the Department issued a Final Order that was in response to a Petition for Variance from Valencia Osceola Campus, Bldg. 4, Elev. #2, filed April 8, 2013, and advertised on April 11, 2013 in Vol. 39, No. 71, of the Florida Administrative Register. No comments were received in response to the petition. The Final Order on the Petition for Variance denies the Petitioner a variance from Rules 2.1.4, 2.12.7.3.7, 2.14.1.7.1(3)(4), 2.27.1.1.3, 2.27.3.1.6, 2.27.3.3.1, 2.27.4, 2.4.6, 2.14.1.6, 2.27.1.1.6, 2.27.3.2.2, 2.27.3.3.7, 2.28.1, 2.4.8, 2.14.4.2.6 and 2.27.3.4, ASME A17.1b, 2009 edition, as adopted by paragraph 61C-5.001(1)(a), Florida Administrative Code that requires control of smoke and hot gases, hoistway access switches, railing and equipment on car enclosure top, emergency communications, phase I emergency recall operations, phase II emergency in-car operation, firefighters’ emergency operation non automatic elevators, maximum upward movement of the car, car enclosure tops, emergency communication, phase 1 emergency recall operation by fire alarm initiating devices, phase II emergency in-car operation, layout drawings, top of counterweight clearances. Passengers and freight car doors and gates, and interruption of power because the Petitioner has not demonstrated that the purpose of the rule will be met or that Petitioner would suffer a substantial hardship if required to comply with this rule (VW2013-112).
