NOTICE IS HEREBY GIVEN that The Board of Respiratory Care has declined to rule on the petition for declaratory statement filed by Thomas Goldman, Esquire, on October 9, 2012. The following is a summary of the agency’s declination of the petition:
The Board of Respiratory Care hereby gives notice of the issuance of an Order regarding the Petition for Declaratory Statement, filed on October 9, 2012, by Thomas Goldman, Esquire. The Notice of Petition for Declaratory Statement was published in Vol. 38, No. 72, of the November 15, 2012 Florida Administrative Register. The Board considered the Petition at a duly-noticed public meeting on November 15, 2012, via telephone conference call. The Petitioner sought the Board’s interpretation of Sections 468.355, 468.358, 468.365 and 468.366, Florida Statutes, and clarification as to whether a respiratory care license is required for his client, a business entity, and its employees to provide hyperbaric oxygen therapy treatment. The Board found that the Petitioner failed to identify how the cited statutes applied to or affected Petitioner’s intended course of conduct and thus found the petition to be legally insufficient. Accordingly, the Board declined to answer, and denied, the Petition. The Board filed its Final Order on April 3, 2017.
