    11B-27.002Certification, Employment or Appointment, Reactivation, and Terminating Employment or Appointment of Officers

    NOTICE IS HEREBY GIVEN That on March 19, 2015, The Florida Department of Law Enforcement Criminal Justice Standards and Training Commission received a petition for permanent waiver of paragraphs 11B-27.002(4)(a) and (4)(b), F.A.C., by Sheriff Nick Finch, Liberty County Sheriff, on behalf of Jessica Ann Page. Petitioner wishes to permanently waive that portion of the rule that states: within four years of the beginning date of a Commission-approved Basic Recruit Training Program, an individual shall successfully complete the program, achieve a passing score on the applicable State Officer Certification Examination, and gain employment and certification as an officer; and, an individual who has not complied with the requirements in paragraph (4)(a) of this rule section for the discipline in which the training was completed, within four years of the date of beginning such training, shall as a condition for obtaining employment comply with the following: 1. successfully complete a Commission-approved Basic Recruit Training Program pursuant to Rule 11B-35.002, F.A.C., or qualify for an exemption from a Commission-approved Basic Recruit Training Program, pursuant to Section 943.131(2), F.S., to include demonstration of proficiency in the High-Liability Basic Recruit Training Courses pursuant to Rule 11B-35.0024, F.A.C.; and 2. achieve a passing score on the State Officer Certification Examination.

    Petitioner states that Ms. Page is a certified corrections officer and has been employed by the Florida Department of Corrections since 2007. Petitioner also states that Ms. Page began cross-over law enforcement training on August 2, 2010 and completed such on March 4, 2011. Per rule, Ms. Page had until August 2, 2014 to become employed as a law enforcement officer. Petitioner states that Ms. Page has demonstrated a high amount of drive and willingness to improve and that she has the characteristics and attributes to make a solid law enforcement officer.

    Petitioner states that Ms. Page is currently employed by the Liberty County Sheriff’s Office on a Temporary Employment Application as a Reserve Deputy Sheriff and will convert to a full time deputy sheriff if the waiver is granted.

    Petitioner states that strict application of the rules would create a substantial hardship on Ms. Page in that she would again have to adjust her work schedule, pay for the Commission-required refresher course and retake the State Officer Certification Exam, all of which will be avoided if the waiver is granted. Petitioner states that the purpose of the underlying statute will be achieved if the waiver is granted.
