    NOTICE IS HEREBY GIVEN that the Board of Optometry received a Petition for Declaratory Statement from John Wachter on February 26, 2015. The petition seeks the agencys opinion as to the applicability of §456.054, Florida Statutes, as it applies to the petitioner. Specifically, whether Petitioner would be subject to discipline if: (a) he, as the operator of a medical practice, were to pay a portion of the fee received for enhanced intra-ocular lens surgery performed by an ophthalmologist to an optometrist who is co-managing the patient’s care; and (b) he, as an optometrist, were to accept a portion of the fee received for enhanced intra-ocular lens surgery performed by an ophthalmologist when he is co-managing the patient’s care. The Board will consider this petition at its meeting currently scheduled for July 15, 2015. Except for good cause shown, motions for leave to intervene must be filed within 21 days after publication of this notice.
